These terms are an agreement between you and Starling Petals LLC ("we", "us") governing your use of the PocketPetal app. By downloading or using PocketPetal, you agree to them. If you do not agree, please do not use the app.
You must be at least 13 years old. If you are in the European Economic Area or the United Kingdom, you must be at least 16, or the minimum age for consent to data processing in your country if that is lower. If you are under the age of majority where you live, you must have permission from a parent or guardian, who agrees to be bound by these terms on your behalf.
You are responsible for what happens under your account and for keeping your login details secure. You may explore the app without an account, but a full account is required for friends, referrals and syncing across devices. Provide accurate information and let us know promptly if you suspect unauthorised access.
One person, one account. Creating multiple accounts to farm referral rewards, badges or identification allowances is not permitted.
PocketPetal is free to use with a daily limit on plant identifications. PocketPetal+ and PocketPetal Pro are paid subscriptions that raise or remove that limit and unlock additional features.

Your photographs remain yours. We claim no ownership of them.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display your photographs solely to operate and provide the app — for example showing your collection back to you, or showing a capture you chose to share with your friends. This licence ends when you delete the content or your account.
Using your photographs to train our plant recognition model is separate and requires your consent, which you can withdraw at any time in Settings. See the Privacy Policy.
You confirm you have the right to upload what you upload, and that doing so does not infringe anyone else's rights.
XP, levels, badges, streaks, streak freezes, rarity tiers and other in-game items are a licence to use features within the app. They are not property, not currency, and have no monetary value. They cannot be sold, transferred or exchanged for anything of value, and we may adjust, reset or remove them as we balance the game.
Rarity is assigned by a random roll at the moment of capture. It reflects nothing about the actual conservation status, scarcity or botanical significance of the species.
Never eat, touch, brew, apply or otherwise consume a plant based on what PocketPetal tells you it is.
Identifications are produced by automated image recognition. They are frequently wrong, and many dangerous plants closely resemble harmless ones. Descriptions and care tips in the app are generated automatically and may contain errors.
PocketPetal is a game. It is not a foraging tool, a field guide, or a source of medical, nutritional, veterinary, horticultural or safety advice. Do not rely on it to decide whether a plant is edible, toxic, medicinal, or safe around children or animals. Consult a qualified expert, and if you suspect poisoning, contact emergency services or your local poison control centre immediately.
You are responsible for your own safety while using the app. Pay attention to your surroundings rather than your screen. Do not trespass on private property, enter dangerous terrain, disturb protected habitats, or pick, damage or remove protected species. Obey all local laws about land access and conservation.
Recording location is optional and can be declined or revoked in your device settings. Captures you share with friends may include the location where they were taken — think about this before sharing anything taken at your home.
You may stop using PocketPetal at any time and delete your account from Settings → Delete Account. Deletion is permanent and your progress cannot be restored.
We may suspend or terminate your access if you breach these terms, or if we discontinue the service. If we discontinue PocketPetal entirely we will give reasonable notice and, where required, refund the unused portion of any prepaid subscription.
PocketPetal is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and the accuracy of any identification or generated content. We do not warrant that the app will be uninterrupted or error-free.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the app, whether in contract, tort (including negligence) or otherwise, shall not exceed the greater of (a) the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (US $100). We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, revenue or goodwill, even if advised of the possibility.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
Nothing in these terms limits liability that cannot lawfully be limited — including death or personal injury caused by negligence, fraud, or your statutory rights as a consumer.
You agree to indemnify us against claims arising from your misuse of the app, your breach of these terms, or content you upload, except to the extent such claims arise from our own negligence or wilful misconduct. This does not affect any mandatory consumer rights you have under the law of the country where you live.
These terms are between you and us, not Apple. Apple has no obligation to provide support for PocketPetal and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
We may update these terms. We will post changes here and update the date above, and will give notice in the app before material changes take effect. Continuing to use PocketPetal after that means you accept the new terms.
These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules.
Any dispute arising out of or relating to these terms or the app will be brought exclusively in the state courts located in Gwinnett County, Georgia, or in the United States District Court for the Northern District of Georgia, and you and we consent to the personal jurisdiction of those courts.
If you are a consumer, nothing in this section deprives you of the protection of the mandatory laws of the country where you live, or of any right you have under local law to bring proceedings in the courts of that country.
